Selling handguns to non license holder?

Post by indiageez » Sat Jan 01, 2011 1:43 pm

Hello IFGians,

I could see lot of sale happening in our Buy/Sell section ...I am having a very basic doubt ..may be I am novoice... Selling lethal weapons to persons who doesnt have license is legal in india? Does our forum have any regulations on that?

The sales section here is merely in the form similar to newspaper "classifieds" - so no actual sale/ purchase can take place on the forum for this the seller/ buyer must transact "offline" after completing the required formalities etc. It is assumed that the buyer and seller will follow all required procedures and this site takes no responsibility in this regard.

You will find similar classified for guns (being offered for sale) in many major newspapers, the same thing is applicable there as well.

Fair question. IFG does not allow any kind of activity or posts that are not in compliance with the law of India. All the sales you see are by license holders or registered dealers. No one is buying anything here. One is merely finding a goods, its location, price and relevant seller. The transactional process of sale, verification of documentation and other legal requirements are the responsibility of both the parties i.e. the buyer and the seller. Not of IFGs. Also, the board is actively monitored by the Moderators and any post that looks suspicious is taken off and the offending member may be warned or banned depending on the explanation or lack of it.

Thank you for raising a pertinent question.Hope this answers your doubt.

Hope the above replies remove your doubts.

We appreciate that you admit that you are a novice but would still like to know what made you think that weapons are being sold here to non license holders or the forum is selling handguns to non license holders?

I hope you can elaborate on this and share your thoughts or give any reasons that made you think so. Thanks.

My sentiments precisely.

Dear mundaire, Vikaram,

Thanks for the explanation ..!!!

Dear Rajat,

I certainly didn't mean that IFG forum is selling weapons ..That was not my question also. I completely understand that this forum acts as a platform for buy/sell and this site doesn't involve in any kind of transactions except for knowledge.

My question was: Do we have any gating that stops/monitor selling weapons to non license holder or the person who is selling is not a registered/licence holder seller? or how do we ensure? or Is it not really IFG responsibility? But, IFG really provides the pointers to goods that are on sale!!! Vikram did mention that all the sales you see are by license holders or registered dealers. Does IFG really maintains/know that the buying and sales here are by licence holders or registered dealer? How do we check on authenticity?

I am sorry I have put lot of questions ...these all are popped up to me when I could see series of inquiries and sale posts every day in IFG and this made me to think like that.

Thanks all for patience in listening.

BK,

It is a complicated process to obtain arms license and to have a weapon listed in this license, and to sell one is not confined to tranfer of money and take away.. :)
It involves a sale notice, available here,
http://www.abhijeetsingh.com/arms/india ... notice.pdf
and post the sale a deletion of weapon from license, form is here
http://www.abhijeetsingh.com/arms/india ... weapon.pdf
and the entry of weapon to buyers license
http://www.abhijeetsingh.com/arms/india ... weapon.pdf
all to the District Magistrate.
and that forthe process.

Anyone who has a weapon in his license, will not give it away wrecklessly to someone, as any misuse will have to be acounted by the license holder, and here it is defintely a criminal offense and nothing else.
that much about license, weapon in license and sale of it,
Do we have any gating that stops/monitor selling weapons to non license holder or the person who is selling is not a registered/licence holder seller?
Will a license holder ever buy from a non license holder a gun, which he will never be able to take in his license? Will a license holder sell his gun to a non-license holder, so that the consequences can be faced by himself? this scenario will rise the moment, the gun is asked to be deposited in the event of a law and order situation or other events like elections, or renewal of license.
or how do we ensure? or Is it not really IFG responsibility? But, IFG really provides the pointers to goods that are on sale!!! Vikram did mention that all the sales you see are by license holders or registered dealers. Does IFG really maintains/know that the buying and sales here are by licence holders or registered dealer? The sale is between two license holders and can happen with the approval of DM, both for the sale and the tranfer. Can IFG check the license of individuals? i guess not, privacy matters more than anything in our world! we are good at discussion and as a platform to bear the purpose.

It should be noted at the same time, that even a hint of unlawful behaviour has not been tolerated at IFG in the past, and i am personally happy about it. Its not been more than 3 months when a guy floated a sale ad, for a NP bore semi -auto pistol, for about 1.5 lakhs which he allegedly did on behalf of his relative in foreign affairs!! he and the post were identified soon, and he was banned!
MODs are keeping a good watch on etiquettes, in a manner that is commendable and appreciable!

legal part can be read at http://www.abhijeetsingh.com/arms/india/laws/

and thanks Abhijeet for having it there, its always been an easy access when needed.. :D

Do we have any gating that stops/monitor selling weapons to non license holder or the person who is selling is not a registered/licence holder seller?
Unless we take it upon ourselves to become moral busybodies to regulate the actions of each and every citizen, probably the question itself would not have arisen. Do the newspapers have any gating that stops/monitors who is selling and who is buying any advertised product or service? Absolutely not because it is non of their business, since the decision to enter into the buy and sell transaction is left to the wisdom and choice of the free citizens of a free country. Same is applicable to any website.
or how do we ensure?
Do newspapers ensure anything about who is selling and who is buying any advertised product or service? Absolutely not because it is non of their business, since the decision to enter into the buy and sell transaction is left to the wisdom and choice of the free citizens of a free country. Same is applicable to any website.
or Is it not really IFG responsibility?
Even though it is not really IFG responsibility, it still goes a step further to remove any suspicious looking advertisements.

the buyer/seller has to verify records depending on purchase and sale as done anywhere else .and its OUR DUTY to be clean NOT THE FORUM.i doubt that criminals will need our forum as everything is recorded and veiwed by the world.i think so far all transactions have been healthy and legal.thanks for bringing this up.
