ALL INDIA LICENSE

Hello folks,
I am from Punjab.just got my All India license.
it has been a great read all the topics here and just about anything i can think of has been covered here.so here goes my first post:

I f a person has been issued an All India License can it be revoked and the area validity be changed to state citing some rule or is it that AIL once issued will stay that way forever?

It depends on the BASIS on which you had obtained the ALL INDIA Validity in the first place. On the comming of the Arms Rules 2016, only the persons with solid proof s laid down in the relevent table can get a All India Validity. Now on any review of your licence during Renewal or Normal scrutinyby NDAL ALIS , if you are not eligible, your Validity can be shrunk.All licences are dead and reborn on renewal as per the new Arms rules 2016. So it is not FOREVER.

veeveeaar has answered your question very well. Would like to add that legal meaning of license is permission. A permission is not a right. The permission is given on certain "terms and conditions". When any of the terms or condition get violated, license can be completely revoked or it's area validity reduced. If for some reason you think injustice has been done or your right violated, you can approach High court, if still do not get justice, may further approach Supreme court. This is why I have always been saying nothing to get elated on getting a "license", rather fight for your basic natural human right, for example here in the post via this link viewtopic.php?f=3&p=251579#p251548

This has been recently amended. All India validity will remain permanently. I will post the original amendment in a day or two.

As per the new notification in Oct 2017, the area validity cannot be changed / amended at the time of renewal.....

Attaching the notification ... refer section2(ii)

Old wine in new bottle and just eyewash. Nothing much to cheer about this amendment, because it clearly says if licensing authority satisfied that all india license is "not required anymore" it can change the area validity. "not required anymore" are the keywords in the amendment and rest is just a decorative story. Earlier also licensing authority decided if all india license was "required" to defend your own life or not, now also the same thing.

anyone who can share their experience when they went for renewal of their existing AIL............by reversal of permission i dont mean when the licence holder gets involved in any criminal activity but in the situation that the reason for which the validity was granted does not exist anymore........for ex a retired defense officer etc

While you may wait till someone tells from his personal experience, but from experience of others I can tell that arms license issue and renewal process is pretty much arbitrary and subject to whims and fancies of the licensing authority, and least rooted in the spirit of Arms Act 1959. They usually don't care whether someone is defense personal or not. But there is nothing much to be panicked or worried. If the license is revoked or area validity is changed arbitrarily, the matter can be appealed to appellate authority, if still no remedy, it can be taken to High Court.

thanks.well usually from what i have seen is that once an AIL always an AIL unless someone ends up doing something really stupid.Just wanted to find out if anyone out here has ever had any issues of such nature............

Can you please elaborate the procedure adopted for All India License though its secondary topic to your concern.

For the applicant, the procedure is same. Apply to local licensing authority, they send the file to home department of state government. If the file gets approved by the home secretary of state government, the applicant is issued all india license. If file is rejected, you can file appeal to appellate authority, still rejected, move writ in High Court or Supreme Court.

Hi IFG, this is my first post as I’ve Newly joined. Very happy to be a part of this great forum.
Need help from the experts!
I recently got my All India Validity from Delhi.
But unfortunately due to the 2016 arms act it’s valid only for a period of 3 years and then I have to get it renewed again. Will the 2017 amendments posted above help me getting it changed to Lifetime validity?
