arms license delhi inheritance category

Hi all,
My self sagar tomer from new delhi, i applied for arms license last month on 18th under inheritance basis as my father expired last year. It is dbbl 12 bore gun which he aquired in 1989 apprx having all over india validity on his license. After completing all formalities i submitted my application on 18th nov and 1week back my verification got completed frm local police station by sho. Though i have a clear background and having govt job i was given hint to give bribe by his reader to get my work done easily though i refused.
My file has reached local dcp office now frm where it will be sent to licensing branch again.
I would like to know frm our respected seniors how can i follow up my application and how much approx time more it will take from now to complete the process? Also as my father had all over india license so i will be issued with same validity??I also heard dcp licensing dont call personally for intervew in case of gun and straightway issue license if it is accepted,is it true?
Kindly put some light on this info.

Dear Sagar,
Most likely you will have the licence with Delhi area validity. A friend of mine had the same case of weapon transfer as his father had expired and left 2 arms. One dbbl gun and one 250/3000 rifle. His father had all India validity but when the weapons were trfd to his name it was only Delhi area validity.

I inherited a gun from my father by way of will and have applied for license last year but till date the licence is not received as the oc local police gave a note..license may not be issued. Can the police give such note on inherited gun? Any such inherited case whose license is issued recently? How to deal? I am also a life member of a rifle shooting club. Please suggest. Regards.

The only legal role of police under Arms Act 1959 is searching and furnishing the criminal records of the license applicant to the licensing authority. Anything else written by police has no meaning or value under Arms Act 1959.

You have legal right to get license for the inherited property(gun) unless there is something within the Arms Act 1959 that clearly prohibits you from getting license. For example below 21 years of age or of unsound mind etc. etc.

What does the licensing authority say? If they are refusing, politely get the reasons for refusal in writing. Then appeal to the appellate authority. If still refused, file a writ in High Court. High Court will direct the licensing authority to issue the license.

As per procedure laid down in Arms Act 1959, after the rejection by licensing authority, there is need to appeal to the appellate authority. If you are confident that you will be able to convince the court, the needlessness of appealing to appellate authority then fine, else appeal to the appellate authority, if still rejected then move court.

If you are serious about moving court, I can email you the copy of the petition referred in this post viewtopic.php?f=4&p=243748#p243735 You or your lawyer will be able to get an idea of the matter, the legal and Constitutional grounds involved and accordingly draft your petition.

I have approached the local police station who said that since I do not have any life threat record they won't grant the approval of the licence. How to resolve? Anyone in this forum have received new license under inheritance category?

Sent the copy of the petition to your email address. If you are residing in or around Delhi, it would also be useful to contact and co-ordinate the matters with those who are taking this matter to Supreme Court.

Hi Sagar,

Its illegal to pass judgement on any application without giving a chance of hearing to the applicant. If he does not calls for a hearing, we can challenge the same.
