THE SPIRIT AND LETTER OF "PRIVATE DEFENCE"

Post by pkaran » Sun Aug 29, 2021 3:50 pm

The law does not require a law-abiding citizen to behave like a coward when confronted with an imminent unlawful aggression. As repeatedly observed by this court (The Supreme Court) there is nothing more degrading to the human spirit than to run away in face of danger. The right of private defence is thus designed to serve a social purpose and deserves to be fostered within the prescribed limits.

Hi pkaran,

India has a lot of potentially good laws but looking from a pragmatic point of view, the Supreme Court doesn't have the autonomy/clout to force politicians to spread awareness among people about their right to self defense because if the common man realizes every law biding citizen is potentially a target of organized/petty crime/robbery/theft/criminal intimidation/assault/mugging, atleast once or twice in their entire lifetime, which im sure everyone would have/will go through at some point in their lives, then people would arm themselves atleast with basic self defense tools, forget weapons.

This would be like a direct challenge to an overwhelming majority of politicians who want to remain Wolves, to lead huge flocks of sheep and still prey on the sheep whenever needed!

India may be a democracy, but there are several issues like significant, all pervasive corruption in all walks of life, poverty, lack of education, politics of caste, creed, humongous lack of awareness among the general public about their basic rights, that have been an impediment to awareness of rights to basic self defense and i don't see the situation improving in the near or even distant future because even after the British were done in India and left for good, they succeeded in convincing the Indian people that to stand up for rights and arm themselves would invite serious consequences.

And now, instead of them, the politicians have filled that vacuum.
Politicians will bend over, touch the feet of people only when they want votes, but once voted to power, they rule and the people cower and take shelter always, when faced with imminent threat/intimidation etc etc etc.
