Indians For Guns

Hey everyone,

My sister and I are NRIs but we have dual citizenship for America and India. My sister is about to go work for an NGO out in the outskirts of UP. I know that us hindustanis are a very peacful people(she worked one year in rajasthan and had no problems) but with so many of us there, there are bound to be a couple of our people who are evil(maybe omkara tainted me lol). In this region there is a huge naxolite/other extremists problem and as an american and and a pretty good looking girl(no incest intended) who is short and scrawny I am very worried about her getting kidnapped/raped etc. I know india has strict gun laws but my deceased uncle was a former MARCOS and owned several weapons which his family has inherited in Kishangarh. I have a couple of questions, and please get back to me soon because she heads out to our motherland on the 9th of November and will be there for 2 years working in the fields for farming development.

I myself own 2 handguns here in the US(An FNP-40 and a springfield armory 1911 in .45) and 2 rifles(a mosin in 7.62 and an AR-15 variant in 5.56)

1. Can I give her my FNP in .40 caliber(10mm) (I know .45 is not allowed so the 1911 is out of the question) and can she bring it to india? what about one of my rifles(I doubt she'd carry one)

2. Are gas pistols(http://en.wikipedia.org/wiki/Gas_pistol) allowed in india and can she buy one?

3. Can she inherit one of the firearms from my relatives in Rajasthan?

4. What is the legality of NRI(Dual citizen) ownership of firearms?

The Naxalites/ Maoists are usually known to attack people who are working against their interests and ideology. If the NGO is actually working for poor people etc., normally its employees would not be targeted. Many common sense precautions of avoiding trouble like avoiding isolated places, working in large groups and only during day time etc. can be always be taken.

Please read Arms Act 1959, if gas pistol falls in definition of "firearm" as defined in Section 2 of Arms Act 1959, then it needs a license.

Legal heir can inherit subject to no objection from other legal heirs.

4. What is the legality of NRI(Dual citizen) ownership of firearms?

Citizenship has nothing to do with getting an arms license. Arms license is issued on basis of residency and not on basis of citizenship. This has been explained in the first thread mentioned above. BTW dual citizenship is not allowed by the Constitution of India, probably you are confusing "dual citizenship" with OCI card. It has also been explained in the first thread mentioned above.

Thanks for the help you guys. Yeah I checked the arms act of 1959 and the gas pistol is not ok. I just hope pepper spray will be enough.
