Sale of handguns sold to army officers by MOD
Is there any restriction on officers of armed forces selling their handguns like 30 caliber pistol etc issued to them by MOD, there seems to be some apprehension in the minds of the officers,any notification etc would be helpful!

The weapons given to Army Officers and JCOs are not sold by MOD instead they are issued on nominal price ( in case of 7.62mm pistol it is Rs 265/-) on requisition and after recommendation of higher formations made to the Master General Ordnance branch AHQ in accordance to Special Army Order, mass court martial for selling NSP weapon is in process at Ganganagar, the recent notification from AHQ can't be linked on this forum as it is internal orders , refrain from those mouthwatering weapons, can lead you and your Army friend in deep trouble.

AFAIK those officers had not followed the regulations before selling their weapons, hence the trouble. Had they taken permision for sale from the competent authourity before sale, they would not have faced the problem. Are you aware of the details of the charges framed against them? I mean under which Acts, Sections etc. AFAIK one of the charge against them pertains to violation of SAO 1/S/1996 but the said SAO is said to be now not in existence, as it has been superseded by another SAO 4/S/2006.mass court martial for selling NSP weapon is in process at Ganganagar
Can you please give some more details of the notification? Are you referring to SAO 4/S/2006 or some other order?the recent notification from AHQ can't be linked on this forum as it is internal orders
If one reads the judgment at http://aftdelhi.nic.in/benches/jaipur_b ... 022010.pdf you will find that it has been contended that para 25 of SAO 4/S/2006 clearly provides that resale of NSP weapon/s will be governed by Arms Act, 1959. If this is the legal position now then the sale/purchase of NSP weapons will be like any other weapons under Arms Act 1959 i.e. by taking permision from Licensing Authourity under Arms Act 1959.
This can be verified by obtaining a certified copies of SAO 4/S/2006 and any other notification/s or order/s that are in force to regulate the sale of NSP weapons by doing an RTI application with Ministry of Defence.

The SAO 1/S/96 was reviewed in 2006 and hence SAO 4/S/2006 is regulated, the only and major difference in both the regulations are that the Officers and JCOs retiring or retired are now in CAT- III earlier were placed in CAT- I, there has been no clear cut directions on who is the authority for permission of sale, however after SAO 4/S/2006 it is clear that an Officer or JCO can transfer his weapon to an Officer or JCO by the permission of OS-15A, amount would remain same and will be deposited in the treasury, the issue for sale of NSP weapon raked up only at Ganganagar courtesy clerk at ADM office who didn't receive his percentage, I am not referring to SAO 4/S/2006 but instructions from AHQ. I believe you are in Army check it on Intranet in MGO branch Directorate. The cases which are under the process of Court Martial are only of Ganganagar, lord be with those, the day when they ( Army/Police ) start scrutinizing all 7.62, 7.63, .M1 series rifle, carbine, pistol, all over UP, Punjab, Rajasthan and all over country, Oh my god why I am being nervous and feeling cold, one question, Do I own one ????????
